1. A booking is not deemed to be confirmed until a non-refundable deposit of 25% or other amount agreed between Prism Entertainments and the Customer has been paid.
2. Financial settlement to take place by cash at the start of the event, or by cheque no later than fourteen days prior to the event. If additional performance time is required, the fee for such time must be agreed with, and paid to Prism Entertainments at that time.
3. This contract reflects the verbal agreement, and shall include any terms and conditions agreed prior to its issue, and shall be deemed accepted unless a written objection is received within fourteen working days of the issuing date. No alterations may be made to this contract by either you (the Customer) or us (Prism Entertainments) without prior approval by both you (the Customer) and us (Prism Entertainments).
4. In the event of you (the Customer) wishing to cancel this contract for any reason other than Act of God or National Disaster, any advance payment made will be forfeited. If the cancellation is within one calendar month of the event 100% of the agreed fee will be payable. If the cancellation is within three calendar months of the event 50% of the agreed fee will be payable. If the cancellation is more than three calendar months from the date of the event only the deposit will be forfeited.
5. Prism Entertainments reserve the right to substitute a similar entertainer in the event of Prism Entertainments being unable to appear for any reason.
6. You the customer will ensure the owner or management of the venue allow suitable time for the installation and dismantling, and removal of equipment (normally two hours).
7. You the customer must also ensure that safe and adequate power supply is available. This must be a minimum of two 13Amp sockets with a combined minimum continuous load capacity of 4.5Kilowatts (20 Amps).
8. Prism Entertainments ensures that all equipment that requires connection to the mains power source is electrically safe and conforms to the HSE EAW Act 1989, and any amendments thereafter. All equipment will also have passed portable appliance tests (PAT) and certificates available to be viewed by prior arrangement if necessary.
9. Prism Entertainments and their assistants will conduct themselves in a proper manner throughout their attendance at the venue, and will respond to you the customers requests as to volume, siting (as appropriate) of equipment and, or any other reasonable requests.
10. Prism Entertainments shall be in no way liable for breach of byelaws, or conditions under which the venue is leased, hired or entrusted to you the customer. You the customer also ensure that all appropriate licenses, as required by law, are in force at the time of the event.
11. You the customer must provide adequate supervision of all your guests at the venue, and will be liable for any loss or damage to the equipment, vehicles or personnel belongings caused by guests, customers and/or staff.
12. Prism Entertainments offers assurance that no previous contract exists that may prevent them from fulfilling the event referred to in this contract and subsequently, no such contract will be entered into from the date of signing.
